THERE is much debate about the 2020 US elections. However, there are neither cogent arguments nor consistent scientific analysis that explain what is going on. This article seeks to cut through the noise and bring rationality and reason to the discourse. GUEST COLUMNIST: AUTHOR. G. O. MUTAMBARA A new electoral system In their national efforts to mitigate the impact of the COVID-19 pandemic on the November 2020 electoral process, the United States, through its various States, introduced a new electoral system with the following provisions: Postal ballot voting for anyone who wants to use it; Early in-person voting for anyone who wants to do so; Election day, in-person voting. This contrasts with the old system: Election day, in-person voting (as the primary electoral method); Postal ballot voting for a few who apply and justify; Early in-person voting; only for a few exceptional cases. Although the new electoral system was put in place to mitigate COVID-19, it presents different and better voting opportunities to citizens than the old system. It is not equivalent to the old system. Why do we say this? The new system makes it easier and less onerous for a citizen to cast a vote. The new system leads to a higher turnout for every candidate who embraces it. For purposes of illustration, if a candidate has 100 supporters, under the old system, we can assume 60 will vote, whereas under the new system the number will increase say to 80. There are various reasons why supporters do not cast their votes. Under the new system, those reasons are reduced, hence the increased turnout. Another impact of the new electoral system was to remove voting logistical constraints experienced in some constituencies such as few polling stations, prohibitive documentation requirements, and other voter suppression shenanigans. The new system radically enabled the voter. Trump’s strategic error Donald Trump did not embrace the new system, while Joe Biden did. Trump's wrong assumption was that all his supporters would show up on election day, November 3, 2020. He did not understand that the new system has the potential to affect the turnout for every candidate. Biden and the Democrats whole-heartedly embraced the new system and mobilised their supporters to take advantage of postal votes and early in-person voting. In some cases, Trump did the opposite by casting aspersion about the new system, thus discouraging his supporters from utilising postal voting and early in-person voting. This was disastrous. Trump practised voter suppression against himself. If he did not like the new system, he had two options: Launch legal challenges at the state level to stop the new system in all the states, way before the election date. Of course, this was not going to succeed because the states have the power to run elections in the United States. The Federal Government has no role. Having failed to stop the new system, Trump should have embraced it and encouraged his supporters to utilise it maximally. He did not exercise either of these two opti

By Everson Mushava GOVERNMENT yesterday reviewed salaries for civil servants by 40% effective November 1, which will see teachers earn about $18 237. The amount will be inclusive of a 10% risk allowance aimed at getting the educators back at work. “Noting its obligations to pay a decent wage, government has reviewed upwards the salary increase offer to civil servants to 40% which will be awarded to deputy director grade and below,” Information minister Monica Mutsvangwa told a post-Cabinet Press briefing yesterday. “In addition to the salary increase, the teachers will also be awarded a 10% risk allowance. The new basic salary package for the teacher is now $18 237, which is above the poverty datum line. “This means that the compounded review percentage of the teacher grade salary is 1 284% since the beginning of the year. The lowest paid civil servant will receive a salary of $14 528. This is effective from November 1, 2020.” Teachers last week turned down a 20% salary hike, demanding US$520 which government insisted was unable to pay. They have been on strike since September 28 when schools reopened for examination classes. Schools opened on Monday for the last phase, but students were sent back home after teachers failed to turn up. Zimbabwe Teachers Association chief executive Sifiso Ndlovu yesterday said it was too early for teachers to comment on the new offer. “We will need to consult our membership and respond. We need to analyse the indicators from those figures. Any offer should be accompanied with the promise on when we will get to the promised land, that is the US$520 salaries,” he said.
BY MOSES MATENGA /HARRIET CHIKANDIWA HIGH Court judge Justice Erica Ndewere has asked President Emmerson Mnangagwa to probe the conduct of Chief Justice Luke Malaba, arguing his interference with judges’ independence was a danger to the judicial system. This came as the hearing to interdict Mnangagwa from suspending her will be heard before Justice Benjamin Chikowero today after Judge President Justice George Chiweshe ignored her request to have a retired judge for her case. In August, Justice Chikowero dismissed former Supreme Court judge Justice Francis Bere’s application challenging the legality of a tribunal set to determine his fitness for office. Yesterday, Justice Ndewere’s lawyers Mtetwa and Nyambirai also wrote to Chief Secretary to the President and Cabinet, Misheck Sibanda, asking him to restore the judge’s salary and benefits as the action was unlawful. In a letter dated November 5, 2020 addressed to Mnangagwa and copied to Malaba, the Judicial Service Commission (JSC), Judge President George Chiweshe and Justice, Legal and Parliamentary Affairs minister Ziyambi Ziyambi, Ndewere said the Chief Justice’s continued threats on judges and interfering with their duties was “destabilising” operations of the High Court. “I do so with hope and expectancy that your office will seriously look into what I consider the worst form of judicial interference in the work of the High Court by the Chief Justice,” Ndewere’s letter read in part. Ndewere was last week suspended by Mnangagwa and a tribunal was set up to inquire into her suitability to hold the “esteemed office of a judge”. A three-member tribunal chaired by retired Judge Justice Simbi Mubako has been set up and includes lawyer Charles Warara and Yvonne Masvora. Justice, Legal and Parliamentary Affairs permanent secretary Virginia Mabhiza is its secretary. Ndewere is being accused of conduct inconsistent with a judicial officer, reportedly for slipshod work and a batch of delayed judgments. Police besieged her Mandara house at the weekend and removed security as per the JSC request following her suspension. Added Ndewere in her letter: “The interference by the Chief Justice affects the independence and impartiality of judicial officers when they make decisions in cases before them. “A failure to investigate the conduct of the Chief Justice will adversely affect the entire justice delivery system which will in turn negatively impact on Your Excellency’s attempts at attracting foreign investors into Zimbabwe. “I also mention that there have been instances where judges exercised their independence and rendered decisions which accorded with their understanding of the law and the facts, only for the Chief Justice to react negatively against the decisions, resulting in late appeals or reviews designed to secure the decision favoured by the Chief Justice. “It appears the Chief Justice wants all judges to reason and decide as he would have done had he been the one seized with the matter. The two teams clash in Algiers tomorrow before the return match at the National Sports Stadium on Monday. However, the Warriors will go into the matches without one of their influential stars Munetsi, who pulled out of the ties due to an injury. Reims claim that the defensive midfielder was injured despite playing the whole match in a 4-4 draw away to Lens on Sunday. He was supposed to travel soon after the match, but his club instead wrote to Zifa saying he could not make the trip. Warriors general manager Wellington Mupandare said they had written back to Reims demanding that the French club releases the player so that he could be assessed by the national team doctors. “We have asked them to release the player so that he can be assessed by our doctors this side,” Mupandare said. Clubs especially from Europe have regularly clashed with national teams for the release of their players, and should they refuse to report for national team duty, the club risk a fine by Fifa. The second leg will be played in Zimbabwe a week later. De Jongh yesterday said he would carry out research on Costa do Sol, adding that the match would be tough. “It’s a tricky draw because football in Mozambique has made big strides in the last five years. THE International Cricket Council (ICC) has congratulated former Zimbabwe captain Elton Chigumbura for a successful career that saw him compete in all three formats over a period of 16 years. The 34-year-old, a regular at top ICC events including three Men’s Cricket World Cups and five T20 World Cups, has decided to retire after the T20I series against Pakistan in Rawalpindi. ICC chief executive Manu Sawhney said: “I congratulate Elton for an impressive career that saw him succeed across formats for a number of years. He was a fine ambassador of the game and came up with notable contributions with both bat and ball across formats. “I hope Elton will continue to be associated with the game after retirement and use his considerable experience to promote the game in his country and outside. US Secretary of State Mike Pompeo refused to answer a question over whether or not the US State Department was standing in the way of a succesful transition by the incoming administration of President-elect Joe Biden.
On Tuesday, he told reporters that the \"transition\" to a second Trump term would be \"smooth,\" but later said the State Department was prepared for any eventuality.
A week after losing the US election, President Trump remained shut up in the White House on Tuesday, pushing an alternate reality that he is about to win and blocking Democrat Joe Biden's ability to prepare the transition.
The outgoing President has refused to concede to his opponent. President Trump has however mounted a string of flimsy court challenges in states where Biden won.
Several suits have been thrown out almost immediately and the remainder clearly have no chance of overturning Biden's slim but convincing victories in multiple states.
