LAST Wednesday, the Zimbabwe Elections Support Network (Zesn) hosted a virtual public meeting to discuss the topic The Suspension of By- Elections in Zimbabwe: A Necessity or an Affront on Constitutional Electoral Democracy? Guest Column:Zesn The panellists included high-level constitutional and electoral experts namely Pearl Matibe, Alex Magaisa, Ellen Shiriyedenga, Sithabile Dewa and Advocate Eric Matinenga. The meeting interrogated the legality of the indefinite suspension of by- elections and the implications of such a development on constitutional electoral democracy. Statutory Instrument 225A was instituted to suspend elections in Zimbabwe for an indefinite period, citing the need to protect citizens and election officials from the COVID-19 pandemic. This came after the Zimbabwe Electoral Commission (Zec) had developed and published its COVID-19 policy on electoral activities which was also followed by an announcement on tentative dates for the by-elections. Panellists were in agreement that the suspension of the by-elections is illegal since it is unconstitutional and a breach of the law. Magaisa noted that the Constitution is the supreme law of the country, and any law that is inconsistent with it is void to the extent of its inconsistencies. Section 158(3) of the Constitution states that polling in by-elections to fill vacancies in Parliament and local authorities must take place within 90 days after the vacancies occurred, unless the vacancies occur within nine months before a general election. It was also noted that SI 225A is a regulation which is sub-legislation, therefore, cannot be used to make any amendments to the Constitution, neither can it be used to suppress fundamental freedoms and rights. Shiriyedenga noted that Statutory Instrument 225A of 2020 stifles democracy, and hinders the rights of Zimbabweans to express themselves politically. She cited the example of a ward in Chiredzi which has had no representative since January 2020. This, according to her, is an affront to democracy as it interferes with the right of the people to be represented. Panellists also cited Section 134 of the Constitution which states that statutory instruments must not infringe or limit any of the rights and freedoms set out in the Declaration of Rights. Asked about the implications of the Statutory Instrument on the independence of the Zec, Magaisa was of the opinion that this piece of legislation has further compromised the effectiveness of the election management body. He blamed the Zec for being inconsistent with its mandate at times, which has opened it to mistrust and ridicule. He noted that the Zec must be in a position to safeguard the electoral space and should be more professional and impartial. It was also noted that SI 225A is a regulation which is sub-legislation, therefore, cannot be used to make any amendments to the Constitution, neither can it be used to suppress fundamental freedoms and rights. Shiriyedenga noted that Statutory Instrument 225A of 2020 stifles democracy, and hinders the rights of Zimbabweans to express themselves politically. She cited the example of a ward in Chiredzi which has had no representative since January 2020. This, according to her, is an affront to democracy as it interferes with the right of the people to be represented. Panellists also cited Section 134 of the Constitution which states that statutory instruments must not infringe or limit any of the rights and freedoms set out in the Declaration of Rights. By SIMBARASHE SITHOLE FARM workers in Mazowe on Saturday received farming inputs through the government-sponsored Pfumvunza programme. The programme targets to feed industry with raw materials for production purposes and to supply small holder farmers across all eight rural provinces with 1,8 million tonnes of cereals and 360 000 tonnes of oil seed in the forthcoming summer cropping season. Under the programme, farm workers in ward 34 in Mazowe district received inputs during an event spearheaded by local Zanu PF councillor Edwin Chinotimba. He hailed the government for distributing inputs before the rainy season, saying it would go a long way in ensuring food security. “We would like to thank the government for giving us inputs before the rainy season. This will surely improve the livelihoods of people and food security of the country,” Chinotimba said. He warned the farmers not to sell the inputs. In past programmes such as the Command Agriculture, beneficiaries were accused of selling inputs. “I am issuing a warning to you not to sell these inputs as that will shatter President Emmerson Mnangagwa who is trying to mitigate hunger,” Chinotimba said. Eunice Yuvera (60) of Tafdale Farm praised the programme for availing inputs early. “This programme is a necessity because we cannot afford inputs, but the government has greatly assisted us and the timing is good as the farming season is just starting,” Yuvera said. Another farm worker, Diston Jimali claimed that government was not distributing the inputs on party grounds. “This programme is very exciting because it is not being issued on party grounds. Everyone who is interested is benefiting,” Jamali said. Under the programme, farmers are expected to plant three different crops that include cereals, oil seed and cash crops.

Most countries face a daunting challenge on whether to be more inclined towards economic or social development. There is wide range of reasons, though some not so teleological, underpinning this conundrum. And in most cases, the choice of approach is largely influenced by political considerations over development. Most major global economies are built on the foundation of economic development models which presume that when major economic sectors such as agriculture, mining, industry, trade, transport, irrigation, power resources and others have improved, they will have a trickle down effect on social development. This is the case, at least, with most Western economies that were established in the 17th up to 20th centuries — which today have stronger welfare systems. For most of these, the ability of their societies to sustain themselves largely depends on their key economic sectors’ ability to thrive with a stronger knock-on effect on other dependent sectors. When major economic sectors improve, they remit taxes needed to run government affairs, spruce up the service industry and banking sectors and create an environment which enables the improvement of economic conditions of the people. This includes creation of employment and other economic opportunities. The model also assumes that better employment and economic opportunities increase incomes which enable people to improve their standard of life. Its critics, however, argued that it is a centralised approach which ensures that government support towards economic growth is only channelled to few individuals who run the economy with the rest of population reduced to providing labour. However, in a scenario where proper national planning is in place, it is possible to dovetail national economic development with community-level economic development to ensure that economic activity is not only limited to huge corporates. To achieve this, an efficient and robust community driven economic sector will need to be based on effective social development strategy. This means that if an economic development programme has been effective in sustaining government fiscal requirements, part of the resources can be used to implement a national social development plan with the goal to improve the well-being of every individual in society and to ensure they can achieve their full potential. While effective economic development strategies can help to improve the national development indicators, the real success is seen in how nations and societies facilitate the wellbeing of each and every citizen. This entails the provision of public healthcare, education, housing, drinking water, power and others which together contribute to an improvement in the standard of life and citizens’ social status.
