HIGH Court has dismissed an application by Yolanda Kuvaoga seeking cancellation of a burial order for her late daughter, fitness trainer and model Michell “Moana” Amuli, paving way for the father, Ishmael, to proceed and bury her daughter at Warren Hills cemetery today. BY CHARLES LAITON Family spokesperson, Yussuf Binali has confirmed the late model will now be buried today. Moana died in a horrific accident three weeks ago that also claimed the lives of socialite Genius “Ginimbi” Kadungure, Malawian businessman Limumba Karim and Mozambican model Alicha Adams. While Ginimbi was buried two weeks ago, Moana’s burial has been delayed by endless feuds between her parents who are on separation. Kuvaoga had approached the High Court seeking to bar Ishmael the right to bury Moana according to his Muslim religion, claiming she raised the model and wanted her to be buried against the father’s religion. She wanted to host the funeral on the basis that Moana’s father is Muslim and would not allow mourners to imbibe and consume pork at a funeral. But Justice Pisirayi Kwenda, in his detailed judgment, castigated Kuvaoga for over emphasising her late daughter’s secular habits on a mistaken belief that it gave her an elevated social standing in her last days. “The validity of the burial order in first respondent’s (Ishmael Amuli) possession designating Warren Hills as the deceased’s final resting place has been confirmed by this court and the second respondent (Registrar of Births and Deaths) cannot validly issue another burial order,” Justice Kwenda said. “…A court of law may not be called upon to determine a dispute about whether or not mourners should be allowed to imbibe and consume pork at a funeral. “The relevance of what the applicant (Yolanda Kuvaoga) says was the deceased’s worldly lifestyle and her alleged celebrity status to the rites to be followed at her burial is difficult to fathom. I do not have evidence before me of what the applicant says was the deceased’s celebrity status.” The judge added: “It appears to me that the applicant does not appreciate the possible implications of over emphasising the deceased’s secular habits which she believes gave her an elevated social standing in her last days because she could be basking in the grandeur of the perceived status.” The judge further said Kuvaoga’s oral evidence before the court had no relevance to the relief she was seeking before the court adding she submitted that, because her former husband did not pay lobola for her, according to custom and tradition, mourners should gather at her parents’ home in Highfield for the funeral. “That is not the relief she seeks,” the judge said. “In any event that has not been resisted by the first respondent. He paid a customary price to his in-laws for the funeral wake at applicants’ parents’ house. “On the other hand, it is correct that the deceased was born to the Amuli family. The right to family is fundamental and protected in our Chapter 4 Bill of Rights. It is a constitutional value that may not be taken lightly. “It is to

It’s been a month since Algerian President Abdelmadjid Tebboune was transferred to Germany for a specialized medical treatment. He has yet to return to the country.

The 75-year old was transferred on Wednesday October 28th a day after the presidency announced his hospitalization without explaining the cause.

Senior officials in Tebboune’s entourage in Algiers had developed symptoms for the novel coronavirus. The president was placed in what the government called ‘’voluntary preventive confinement.’’

It is not clear whether the Algerian president’s hospitalization was connected to exposure. State Television reported that his condition was stable.

The absence of president Tebboune has raised concerns about the vacancy of power as was the case during the hospitalization of former president Abdelaziz Bouteflika abroad after his serious stroke in 2013.

His brother Said Bouteflika then took over the reins of leadership and tried to impose a 5th term of office for Mr. Bouteflika. This forced Algerians to take to the streets in February 2019. Mr. Bouteflika stepped down on April 2 that same year under the double pressure from the army and the unprecedented and peaceful popular Hirak uprising.

Since his absence from the country to Cologne, Germany aboard a French medical plane, according to Algerian media, six communiqués, sometimes contradictory, have been issued by the presidency.

Following announcement on October 28 that Mr. Tebboune was hospitalized in Germany for \"thorough medical examinations\", the presidency explained the next day that he was receiving \"adequate treatment adding that his state of health was \"stable and not worrying\", without indicating what the president was suffering from.

On November 3, the presidency announced that he was infected with Covid-19. Five days later, it indicated that the head of state was \"on the verge of completing his treatment\". Then on November 15, another statement said that he had completed his treatment and was undergoing \"medical examinations\".

GOVERNMENT and stakeholders must collaborate in adopting the recently launched International Telecommunications union (ITU) child online protection guidelines to guarantee child online protection as children become more vulnerable in the use of digital media. BY HARRIET CHIKANDIWA Postal and Telecommunications Regulatory Authority of Zimbabwe (Potraz) director-general Gift Machengete made the call in his speech read on his behalf by the regulatory authority’s head of consumer affairs and publicity, George Manyaya, at the Childline Online Safety Guidelines launch yesterday. Machengete said children had become exposed to digital media due to circumstances including the COVID-19 induced lockdown that has necessitated e-learning, hence the need for parents and stakeholders to be vigilant in ensuring their safety. “How can we ensure an effective child protection system in Zimbabwe? “It is now the right time Zimbabwe starts reflecting on the need to come up with standalone legislation on child online protection,” Machengete said. “As the regulator of the telecommunications sector, we will be leading all stakeholders in adopting the comprehensive ITU child online protection guidelines and an aggressive campaign will be conducted in schools and communities across the country.” He added: “The internet has transformed how we live. “It is entirely integrated into the lives of children and young people, making it impossible to consider the physical and digital worlds separately.” At least one-third of all internet users today are children and young people with Unicef estimating that 71% of young people are already online. Machengete said as a result of the COVID-19 induced lockdown, most children are spending time online where there encounter all sorts of challenges including cyberbullying and pornography that needs a hands-on approach by parents to overcome. “While the internet has brought about convenience owing to rapid digital transformation, it has also brought about a plethora of challenges. “Children are exposed to various vulnerabilities and there has been an increase in the misuse of technology. “Several children are accessing various sites even without their parents’ consent. “We are providing these gadgets to children but they are accessing sites like Tinder, house party, Instagram, Facebook and Tik Tok without their parents’ or guardians’ consent.” He said issues of cyberbullying were also rampant while most children were also engaging in sexting and pornography despite glaring effects to their lives. “Some are sending too many pictures online for example on Tik Tok and Facebook, exposing themselves and their families.” The International Telecommunications Union (ITU), Machengete said, was in the process of adopting the Child Online Protection Guidelines as part of its quest to ensure maximum protection of children online. He said the issue of children online protection was a collective responsibility hence parents; guardians, government non-governmental organisations and other stakeholders should play a part as chil
