A PENAL mason will pay a fine and be registered as a sex offender after he pleaded guilty to having sex with a female under the age of 14.
Parmannd Bachan, 28, who was indicted under the name Avie Bachan, appeared virtually from one of the Judiciary’s virtual access centres for his sentencing on Wednesday.
He pleaded guilty on August 18 and was sentenced by Justice Hayden St Clair-Douglas who, in addition to imposing the $5,000 fine, also ordered Bachan to report to the Penal police station every year for five years.
Bachan’s name will also be put on the National Sex Offenders’ Registry and the sex offenders’ website, in accordance with the Sexual Offences Act.
St Clair-Douglas said the punitive objective of deterrence in imposing a sentence was not paramount in this case, because the offender was not likely to re-offend.
He also said he took into account Bachan’s remorse; the fact there was no orchestration, planning or grooming in the commission of the offence which took place on January 26, 2012; and the impact on the covid19 pandemic if a custodial sentence were imposed.
It was the prosecution’s case, which Bachan accepted, that on the day in question, at Rochard Douglas Road, Penal, the victim, then 13, called out to him as he passed by her home.
She was home alone, although her mother had sent her to a neighbour’s home while the mother was in the hospital. The girl returned home and invited Bachan into the house.
He initially refused, but when she invited him again, he went in.
Bachan joined the girl on a hammock and she began kissing him. They then went into a bedroom, where she suggested they have sex.
The facts, as read out by the judge, said Bachan again refused but eventually gave in, asking her if she was sure she wanted “to do this,” and she said yes.
They then had sex.
“She was a willing, encouraging participant,” the judge said but maintained that that was not a defence that the court considered a mitigating factor. St Clair-Douglas reminded that under the law, the penalty for sex with minors carried a life sentence, emphasising: “Sex with underage females is off limits and punishment will be severe.
“It will not avail a man to point out that the virtual complaint was precocious,” he said.
But the judge said each case must be examined on the basis of its individual facts.
“The fact that the virtual complainant willingly participated in the sexual activity is not a factor to ameliorate the sentence with a reduction.\"
He said Bachan was 18 at the time of the offence, had a clean record before and has not reoffended since.
“It was a one-off offending,” he said.
The judge started with a sentence of two and a half years, or 30 months, and reduced it by a year because of the mitigating circumstances attributed to Bachan’s age at the time, his clean record, and his remorse.
From the remaining 18 months, he received his one-third discount for his guilty plea, leaving 12 months.

The first of two shipments of the Pfizer covid19 vaccine being donated to Trinidad and Tobago by the US arrived at Piarco Airport shortly after noon on Thursday.
The shipment contained 304,200 doses of the vaccine. It represents the second tranche out of 907,920 that the US is donating.
Present to meet the donation at the airport were CMO Dr Roshan Parasram, Foreign and Caricom Affairs Minister Dr Amery Browne, U.S. Embassy chargé d’affaires Shante Moore, and Caribbean Public Health Agency (CARPHA) executive director Dr Joy St. John.
TT received an initial donation of 305,370 doses of the Pfizer vaccine in August.
A second shipment is scheduled for Friday morning.
In a statement on Wednesday, Browne thanked the Government of the US for \"this generous donation, which is the result of sustained dialogue, diplomacy, and negotiations involving the Government of US, the Government of TT, other Caricom member states, the Caricom Secretariat, CARPHA and Pfizer.”
The statement said the Prime Minister, while he was chairman of Caricom, initiated and led the effort to acquire vaccines on behalf of TT and Caricom, and since then, the Government of TT has continued to acquire WHO-approved covid19 vaccines. The Ministry of Health will use these vaccines in its national rollout.

An Arima woman came to the rescue of a 61-year-old relative when he was attacked by bandits in Arima on Tuesday night.
Police said the man was at Demerara Heights, Arima at around 8.30 pm when two men approached and announced a robbery.
One of the bandits beat the man on the head with the gun.
The relative saw the attack and called for help. She then attacked one of the bandits by biting him on his left thumb.
The bandits ran away.
Arima police were called in and are continuing enquiries.

Minister of Public Administration Allyson West said the government of TT did not support the reappointment of Prof Sir Hilary Beckles as vice-chancellor of UWI when his term expired on July 31.
She was responding to questions in the Senate from Opposition Senator Wade Mark on Monday.
West said there was a government representative on the University Council, which was part of the approval process for the reappointment of the vice-chancellor. She said, as per UWI statutes, a joint committee of council and its senate reviewed the performance of the vice-chancellor and presented its findings to the council, but did not reach a consensus on its recommendations about his appointment.
“The government considered a number of reports, in particular the 360 assessment of the vice-chancellor, the vice-chancellor’s self-assessment, the attained report of 2016, the report from the chancellor’s commission on governance, and recommendations of the joint committee.
\"The government noted that the financial position of the university over the years had been renewed and while the government was heartened by the university’s efforts regarding its reputation, the deficit position of the university remained a cause of great concern.
\"Having regard to the need of the role of the vice-chancellor to have a transformative and new outlook in the approach to the business of education, the government did not support the reappointment of the vice-chancellor. We were concerned, and remain extremely concerned, about the financial affairs, and it is for that reason we did not support the reappointment of the vice-chancellor.”
She said the government was not made aware of any breach of established procedures for the renewal of the reappointment of the vice-chancellor. She said TT had appropriate representation on the University Council, as one of 17 contributing countries
Speaking about the renewal of the appointment of UWI St Augustine principal Prof Brian Copeland, West said the government recommended that his contract be renewed for a further two years.
“In light of the effects of the global pandemic on the country, a change in the leadership of the campus was not deemed to be in the best interest of the students or staff of the campus or the government of TT at this time.
\"The tenure of the current principal was reviewed, along with the financial position of the campus, and it was found that his stewardship of the campus, the reduction of the budgets of the campus over the last four years, and the demonstrated thrust of the campus into entrepreneurship and innovation provided evidence to support the continuation of his tenure.”
She said after significant deliberations at the meeting of the University Council on April 30, the council agreed that Copeland should be offered a one-year contract, with the possibility of renewal for another year.

A Penal man was shot dead on Tuesday night when he went to visit a friend who lived a nearby.
Karl Callender, 39, of Charlo Village, died on the spot at Mathura Avenue, police said.
Police said residents heard gunshots at about 11 pm and called for help.
The friend was in the shower when Callender arrived and escaped unhurt after the shooting, police said.
South Western Division and Homicide Bureau Region III found Callender’s body at the side of the house.
Police said in December last year, Callender faced a Siparia magistrate charged with two offences of robbery with violence.
Callender’s murder is the latest of four killings at Mathura Avenue since last year.
On April 12 last year, Visham \"Baby Sham\" Ramdeen, 35, was shot dead near the family’s home. His death came three months after he was released from prison, where he served 17 years charged with murder.
Two months later, Wellington \"Zorro\" Davidson, 52, and his friend Shazard \"Boyie\" Mohammed, 29, were playing cards at a friend's home where gunmen shot and killed them on a couch. The owner was asleep in a bedroom and escaped unhurt.
Davidson, the father of four, lived at Penal Rock Road in Penal.
Mohammed, a construction labourer, lived at Lowkie Trace in Penal.
No one has been arrested.

DAYS after Monday's 14-to-one trouncing of the PNM by the fledgling PDP in the Tobago House of Assembly (THA) election, former Tobago West MP Stanford Callender on Wednesday resigned as chairman of the Tobago Island Council, as disclosed in a PNM statement from PNM PRO Laurel Lezama-Lee Sing on Thursday.
In his resignation letter to council leader Tracy Davidson-Celestine he said all other executive members should also resign.
\"After serious consideration and some introspection and given the outcome of the recent THA elections, I have decided to tender my resignation as chairman of the Tobago Council of the PNM with immediate effect. My decision is to give the party an opportunity to restructure and re-engineer itself going forward.
\"It is also my hope that the executive of the council will do the same.\"
His letter went on to say it had been a pleasure to work along former THA chief secretary Kelvin Charles and Davidson-Celestine as political leaders in Tobago and all party colleagues.
Newsday asked Callender if his resignation might suggest blame was attached to him for Monday's defeat.
He replied, \"I have no blame to attach. The party has lost the election.\"
Newsday pressed on why he resigned if not blameworthy.
He replied, \"I have assessed the situation. We have lost the election. As chairman, this is collective responsibility. I have decided to resign with immediate effect.\"
Newsday asked if anyone else should resign. He replied, \"You will see everything spelt out in my letter.\"
Asked if Davidson-Celestine should resign, he replied, \"I have no comment to make. The decision will be hers.\"
The PNM statement announcing Callender's resignation detailed his political career and paid tribute to him.
It acknowledged receiving his letter of resignation effective as of Wednesday, to let the party restructure and re-engineer itself.
\"The very distinguished and venerable Stanford Callender served the people of Tobago, the people of Trinidad and Tobago, and the PNM for over 35 years.\"
The party said Callender was a temporary opposition senator (1987-1990) and then a government senator (1992-1995), and was elected Tobago West MP in 2001, 2002 and 2007, serving as minister of state in the Office of the Prime Minister from 2001-2010. The statement said Callender was instrumental in the development of the Tobago Island Council.
\"Mr Callender's commitment to the PNM is immeasurable.\"
The statement praised him for working closely with Tobago West MP Shamfa Cudjoe and for THA chief secretaries Orville London, Charles and Davidson-Celestine.
The party said, \"Widely regarded as a trusted elder, many in the PNM frequently sought Mr Callender's wisdom and counsel.\"
Viewing him as \"humble, dedicated, focused and rational,\" Lezama-Lee Sing's statement said, \"I extend my sincerest gratitude to Mr Callender for his decades of yeoman service to party and to country and I wish him all the best in his future endeavours.\"
